Enclosed is a copy of the requested lease (RC2-73-34) with the following redactions:Red redactions – Considered personal data as defined in Data Protection legislation (Data Protection Act 2018 and General Data Protection Regulation (GDPR)). Disclosure of their names would contravene Principle 1 (processed lawfully, fairly and in a transparent manner) and Principle 2 (used for a new purpose outside its specified legitimate purpose) of GDPR; therefore exception 11(2) under EIRs is applied.Blue redactions contain negotiated commercial terms between the tenant and Crown Estate Scotland; therefore, exception 10(5)(e) – “Confidentiality of commercial or industrial information”under EIRs is applied. The reasoning is because it is in the public interest that Crown Estate Scotland is able to operate in a commercially competitive manner. This is because the annual revenue profit is paid to the Scottish Government for the benefit of the public and disclosing commercially sensitive information could adversely affect the ability to get best consideration for transactions.
