Request:
Provide a copy of the standard Crown Estate Scotland lease to fish farms.
Is our understanding correct that fish farms have to hold the correct statuary consents to comply with their lease conditions?
Response:
Attached is a copy of our standard fish farm leases.
We can confirm that a lease of seabed does require that tenants hold the necessary consents (for example, planning permission, a Marine Licence and a CAR licence). Please refer to our published guidance.
As we are not regulators of the finfish farming industry, compliance with and enforcement of statutory requirements is a matter for those regulators tasked under the relevant legislation
