  1. Do you know who owns the bed of the loch within which Finnart is located? CES?
  2. If within CES ownership did CES grant any licences or consents for the marine infrastructure (e.g. jetties) to be installed?
  3. Are there any conditions attached to those licences or consents specifying what is to happen when oil import / export operations cease? (E.g. is there a requirement that the infrastructure be removed?)
Response
  1. The seabed of Loch Long is Crown land under the management of Crown Estate Scotland (CES). Please note, seabed sits below Mean Low Water Springs (MLWS) as depicted on Ordinance Survey maps.
  2. CES have granted leases in respect of the jetties and ancillary works in Loch Long.
  3. The leases (in answer 2) do not contain provisions specifying what is to happen when oil import / export operations cease. 

The lease does, however, require the tenant to demolish, or remove, the jetties and ancillary works, or any other works, and to restore the site(s) to their former or proper condition on expiry or early termination of the lease.
