“As Foundation Scotland is a charity and not a public authority could you please confirm that Crown Estates Scotland’s agreement with the charity to administer their public funds through grants includes an obligation for Foundation Scotland to provide information when requested in relation to those grants via FOI?”
Response:
I have reviewed the contract between Crown Estate Scotland and Foundation Scotland with regards to the administration of the Community Capacity Grants. There are no clauses or provisions which state that Foundation Scotland are subject to FOISA or have any obligations to provide Crown Estate Scotland with information relating to a request for information received.
Crown Estate Scotland and Foundation Scotland are in the process of developing a new contract for the next three years of the Community Capacity Grants. We will add a clause which stipulates sharing of information held by Foundation Scotland in relation to requests for information that Crown Estate Scotland may receive.
