REF 103 – Glenlivet Shooting Rights


Detail who has the shooting rights (all species) for the Glenlivet Estate


Crown Estate Scotland is disclosing some of the requested information to you under EIRs. However, we are applying exception 11(2)-Personal Data contained in the EIRs. Disclosing the tenants name, or any information which could be used to identify an individual would breach Data Protection laws.

Below lists out the current shooting rights on the Glenlivet Estate, the agreements cover all game species.

Enclosed is a plan showing the geographical extent for each.

Lease terms are subject to legislation governing protection of game (examples include but not limited to: Wildlife and Natural Environment (Scotland) Act 2011, Protection of Wild Mammals (Scotland) Act 2002, Nature Conservation (Scotland) Act 2004).

The tenant must comply with all legislation affecting the leased activities; please refer to the copy of an enclosed letter sent out to our tenants who have Sporting Leases that predate the Wildlife and Natural Environment (Scotland) Act 2011. (redactions contain personal data – exception 11(2) in the EIRs is applied)

We consider that your request is a request for information under section 1 of the Freedom of Information (Scotland) Act 2002 (“FOISA”). To the extent that the information contained within the scope of the request is environmental information as defined in regulation 2 of the Environmental Information (Scotland) Regulations 2004 (“EIRs”), we also consider that your request falls under the EIRs.  We have therefore applied the exemption contained in section 39(2) of FOISA and will deal with your request for environmental information under the EIRs alone.
